Based on this, a bill was passed in the Parliament that mandates the formal registration of immovable property transactions, which remains a subject of dispute between the Parliament and the Guardian Council. One of the challenges associated with this issue is the increase in forgery and fraud related to documents. This study is applied in nature and has been conducted using a documentary method by examining laws and credible sources, with the information analyzed descriptively and analytically. As a result, the bill on mandatory registration of immovable property transactions was introduced in the Parliament on <em>January 2, 2017</em> and approved on <em>May 20, 2020</em>. However, after the bill was sent to the Guardian Council for approval, it faced objections. Alongside the significance, validity, and evidentiary power that document registration brings, it also has functions such as promoting ethical and social well-being in society, ensuring transaction transparency, and reducing litigation in judicial courts.</p> </div> </div> </div> </div> </div> </div> </div> </div> </article> <p>قانونگذار معاملات با اسناد عادی را صحیح و معتبر می‌داند، اما در خصوص اموال غیرمنقول این اعتبار را منوط به تشریفات ثبت رسمی می‌نماید. بر این مبنا طرحی در مجلس به منظور الزام به ثبت رسمی معاملات اموال غیرمنقول به تصویب رسید که همچنان محل مناقشه میان مجلس و شورای نگهبان است. یکی از چالش‌های مرتبط با این امر افزایش جرایم جعل و کلاه برداری در خصوص اسناد می‌باشد. این پژوهش از نظر هدف کاربردی و به لحاظ گردآوری اطلاعات به روش اسنادی و از طریق مطالعه قوانین و منابع معتبر انجام شده و اطلاعات به دست آمده به صورت توصیفی-تحلیلی مورد تجزیه و تحلیل قرارگرفته است. در نتیجه طرح الزام به ثبت رسمی معاملات اموال غیرمنقول در 13/10/1395 در مجلس طرح و در تاریخ 31/2/1399 به تصویب رسید. با این وجود پس از آنکه طرح الزام به شورای نگهبان برای تایید فرستاد شد، با ایراداتی مواجه گردید. ثبت اسناد در کنار اهمیت، اعتبار و توان اثباتی که به سند می‌بخشد دارای کارکردهایی مانند سلامت اخلاقی و اجتماعی جامعه، شفافیت معاملات و کاهش دعاوی در محاکم دادگستری می‌باشد.</p> https://www.csjlp.org/index.php/csjlp/article/download/149/90
