Journal Article 2024 11 24 <p>Governance, relying on the normative and positivist domains of public law principles, seeks to engineer the integration of these principles in its formation and continuity to achieve maximum efficiency. Evaluating this matter within a system based on the new Islamic civilization is optimally possible only when appropriate components, foundations, principles, and ultimately, legal models can be identified, analyzed for their efficiency, and operationalized. This study, descriptive-analytical in nature, gathers necessary data using the documentary-library method. The findings indicate that public law principles serve as a prelude to realizing efficiency in governance. Their continuity requires the establishment of a structured and cohesive framework for implementing these principles within governance, society, and their continuous updating. This is essential because the nature of governance is diversifying, and successful governance can only be defined and managed through legal principles adaptable to this framework. Ultimately, it was determined that for governance to ensure its sustainability, it must base its operational foundation on these principles. Additionally, it must create avenues for leveraging these solutions to serve national and public interests as the basis of its macro and micro decisions.</p> <p>حکمرانی با تکیه بر حوزه هنجاری و اثباتی اصول حقوق عمومی در پی مهندسی تمامیت این اصول در روند شکل­گیری و تداوم خویش برای دست­یابی به کارآمدی هرچه بیشتر است. روند ارزیابی این موضوع در نظام مبتنی بر تمدن نوین اسلامی، تنها زمانی به نحو أحسن میسر است که بتوان مؤلفه­ها، مبانی، اصول و در نهایت الگوهای ترسیمی مناسب حقوق را با تحلیل کارآمدی آن‌ها شناسایی و عملی نمود. پژوهش حاضر در این رابطه، از نظر ماهیت، توصیفی- تحلیلی است و با جمع‌آوری اطلاعات مورد‌‌نیاز به روش اسنادی-کتابخانه‌ای، به این نتیجه دست یافته است که اصول حقوق عمومی، مقدمه تحقق کارآمدی برای حکمرانی است و لازمه تداوم آن نیز ایجاد ساختار مدون و منجسمی برای پیاده­سازی آن‌ها در بطن حاکمیت، جامعه و بروزرسانی آن است، زیرا ماهیت حاکمیت در حال تکثر است و یک حکمرانی موفق، صرفاً می­تواند با اصول حقوقی شناور بر این ساختار، معرفی و مدیریت ­گردد. در نهایت آنچه مشخص گردید آن است که شاکله حکمرانی برای تضمین بقای خود، می­بایست محور عملیاتی خود را بر این اصول استوار نموده و زمینه­های اتکا به راهکارهای آن را برای حاکمیت منافع ملی و عامه جامعه به عنوان مبنای تصمیمات کلان و جزء خود فراهم نماید.</p> https://www.csjlp.org/index.php/csjlp/article/download/230/137
