    <Abstract>&lt;p class="BodyStyle" style="text-align: justify; direction: ltr; unicode-bidi: embed;"&gt;&lt;span lang="EN-GB" style="font-size: 10.0pt; line-height: 115%;"&gt;Despite significant developments in the context of transactions motivated by debt evasion in law and civil codes (specifically Article 218 of the former Civil Code amended in 1991), challenges regarding the legal status of such transactions remain unresolved. Not only has the volume of such transactions not decreased, but ambiguities surrounding these transactions have also increased. Furthermore, theoretical perspectives from Islamic jurists have largely neglected these transactions, except in a few cases such as conditions and rulings of transactions. This study aims to examine the transformations of transactions intended to evade debt in Iranian law, Islamic jurisprudence, and Egyptian law. Employing a descriptive-analytical methodology and utilizing documentary library resources, the study interprets and analyzes these transformations in Iran and compares them with Egyptian law, focusing on the enforcement mechanisms for such transactions. The findings indicate that, despite repeated amendments to Article 218 of the former Civil Code (1991), the mechanisms proposed to resolve the current challenges of debt-evasion transactions have so far been ineffective. Therefore, adopting provisions from Egypt’s modern civil laws and integrating them with Iranian transactional laws could yield significant advancements in the legal status of transactions. Additionally, the comparative analysis reveals that Egypt's Civil Code is considered more advanced and progressive than Iran's civil laws. Moreover, the introduction of Article 21 of the Law on the Execution of Financial Judgments (enacted in 2015) with its novel and distinct enforcement guarantees (non-referable) reflects clear and historically Western foundations. Paying attention to these elements could contribute effectively to achieving the research objectives and strategies.&lt;/span&gt;&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;با وجود تحولات بسیاری که در زمینه­ی معاملات با انگیزه فرار از دین درحقوق و قوانین مدنی(موضوع ماده 218 قانون مدنی سابق مصوبه اصلاح 1370)، هم­چنان چالش بر سر وضعیّت حقوقی معاملات به قوّت خود باقی است و نه تنها از کمیّت این نوع از معاملات کاسته نشده بلکه به ابهامات این نوع معاملات نیز افزوده شده است. علاوه بر این، در دیدگاه نظری فقها نیز آن­چنان که باید و شاید جز در موارد معدودی هم­چون؛ شرایط&lt;strong&gt; &lt;/strong&gt;و احکام معاملات به آن توجه نگردیده است. نوشتار حاضر با هدف بررسی تحوّلات معاملات به قصد فرار از دین در حقوق ایران و فقه اسلامی و حقوق مصر که به صورت توصیفی و تحلیلی از روش اسنادی کتابخانه­ای بهره جسته است، به تفسیر و تحلیل تحوّلات معاملات در ایران و تطبیق آن با حقوق مصر و ضمانت اجرای این نوع معاملات پرداخته است؛ نتایج حاصل از دستآورد پژوهش، گویای آن است؛ در حقوق ایران با وجود اصلاحیّه مکرر ماده 218 قانون مدنی سابق مصوب 1370، آن­چه به عنوان سازوکار، در جهت رفع چالش­های فعلی معاملات با انگیزه فرار از دین مطرح شده است، تاکنون موثر نبوده و لذا استفاده از قوانین جدید مدنی مصر و تلفیق آن با حقوق معاملات ایران می­تواند تحوّلات سودمندی را در وضعیت حقوقی معاملات ایجاد کند؛ هم­چنین با تطبیق موضوع فوق نتایج گویای آن است، قانون مدنی مصر از قوانین مدنی پیشرفته و مترقّی نسبت به قوانین مدنی ایران تلقی می­شود از طرفی با وضع ماده 21 قانون نحوه اجرای محکومیت­های مالی مصوب 1394 با ضمانت اجرای نو و متفاوت(غیرقابل استناد) مواجه می‌شویم که دارای مبانی مشخص و تاریخی غربی بوده و لذا توجه به آن می‌تواند در تحقق اهداف و راهبردهای پژوهش موثر واقع گردد.&lt;/p&gt;</OtherAbstract>
