Despite advancements in the development of international treaties such as the Vienna and Paris Conventions, these frameworks still suffer from significant limitations and shortcomings, underscoring the need for substantial reforms. This article first examines ambiguities in legal definitions, including the lack of precise definitions for nuclear damage and hazardous activities, and then analyzes the deficiencies in international treaty systems, such as weak enforcement mechanisms and geographical and legal discrepancies between treaties. Furthermore, the conflict between customary rules and international treaties and the imbalance in the distribution of responsibilities between states and nuclear operators are assessed as barriers to the fair implementation of nuclear liability. Solutions such as designing a comprehensive liability system combining civil and criminal responsibility, establishing international compensation funds, strengthening oversight of nuclear activities through transparent and independent mechanisms, and imposing legal sanctions on violators are proposed. The necessity of enhancing international cooperation through strengthening the role of the International Atomic Energy Agency (IAEA) and creating comprehensive conventions with robust enforcement mechanisms is also emphasized. The article concludes that reforming international treaties and designing an efficient and comprehensive legal framework not only improves the management of nuclear crises but also enhances global trust in the peaceful use of nuclear energy. موضوع مسئولیت بین‌المللی ناشی از فعالیت‌های هسته‌ای یکی از چالش‌های اساسی در حقوق بین‌الملل است که به دلیل تأثیرات گسترده حوادث هسته‌ای بر انسان و محیط زیست اهمیت ویژه‌ای دارد. با وجود پیشرفت‌های حاصل در تدوین معاهدات بین‌المللی مانند کنوانسیون‌های وین و پاریس، این نظام‌ها همچنان دارای محدودیت‌ها و کاستی‌هایی هستند که نیاز به اصلاحات اساسی را برجسته می‌کند. در این مقاله، ابتدا ابهام در تعاریف حقوقی از جمله عدم تعریف دقیق خسارت هسته‌ای و فعالیت‌های خطرناک بررسی شده و سپس نقص‌های نظام معاهدات بین‌المللی، از جمله ضعف ضمانت اجراها و تفاوت‌های جغرافیایی و قانونی میان معاهدات، تحلیل شده است. از سوی دیگر، تعارض میان قواعد عرفی و معاهدات بین‌المللی و عدم توازن در توزیع مسئولیت میان دولت‌ها و بهره‌برداران به عنوان عواملی که مانع از اجرای عادلانه مسئولیت هسته‌ای می‌شوند، مورد ارزیابی قرار گرفته است. در ادامه، راهکارهایی مانند طراحی نظام جامع مسئولیت با ترکیب مسئولیت مدنی و جنایی، پیش‌بینی صندوق‌های جبران خسارت بین‌المللی، تقویت نظارت بر فعالیت‌های هسته‌ای از طریق سازوکارهای شفاف و مستقل و اعمال تحریم‌های حقوقی برای متخلفان پیشنهاد شده است. همچنین، بر ضرورت ارتقاء همکاری‌های بین‌المللی از طریق تقویت نقش آژانس بین‌المللی انرژی اتمی و ایجاد کنوانسیون‌های جامع با ضمانت اجراهای قوی تأکید شده است. این مقاله نتیجه می‌گیرد که اصلاح نظام معاهدات و طراحی یک چارچوب حقوقی جامع و کارآمد، نه تنها به مدیریت بهتر بحران‌های هسته‌ای کمک می‌کند بلکه به ارتقاء اعتماد جهانی به استفاده صلح‌آمیز از انرژی هسته‌ای منجر می‌شود.
