Journal Article 1403/07/20 <p>The enforcement of judgments issued by international courts is a fundamental issue in international law that plays a vital role in ensuring justice, maintaining the global legal order, and strengthening international peace and security. This article aims to examine the factors affecting the enforceability of international court judgments by structurally and functionally analyzing courts such as the International Court of Justice (ICJ), the International Criminal Court (ICC), and special and regional tribunals, including the courts for Rwanda, the former Yugoslavia, and Tokyo. In this context, concepts such as the jurisdiction and powers of these courts, the process of issuing binding judgments, and the challenges related to the cooperation or non-cooperation of states are explored. Additionally, the political and legal impacts on enforcement and the role of institutions like the Security Council in ensuring the execution of judgments are analyzed. The article demonstrates that the reliance of international courts on the cooperation of states and the support of international institutions, including the Security Council, is a primary challenge in enforcing their judgments. Nevertheless, international courts have significantly contributed to the development of international law by articulating new legal principles and addressing international crimes. Finally, the article offers suggestions for strengthening enforcement mechanisms, enhancing international cooperation, and reducing the influence of political considerations, which can help increase the effectiveness of enforcement and bolster the international justice system.</p> <p>ضمانت اجرایی آرای صادره از محاکم بین‌المللی یکی از موضوعات اساسی در حقوق بین‌الملل است که نقش حیاتی در تأمین عدالت، حفظ نظم حقوقی جهانی، و تقویت صلح و امنیت بین‌المللی دارد. این مقاله با هدف بررسی عوامل مؤثر بر ضمانت اجرایی آرای محاکم بین‌المللی، به تحلیل ساختاری و عملکردی محاکمی نظیر دیوان بین‌المللی دادگستری (ICJ)، دیوان کیفری بین‌المللی (ICC)، و محاکم خاص و منطقه‌ای از جمله دادگاه‌های رواندا، یوگسلاوی سابق، و توکیو می‌پردازد. در این راستا، مفاهیمی نظیر صلاحیت و اختیارات محاکم، فرآیند صدور آرای الزام‌آور، و چالش‌های مربوط به همکاری یا عدم همکاری دولت‌ها مورد بررسی قرار می‌گیرد. همچنین تأثیرات سیاسی و حقوقی بر ضمانت اجرا و نقش نهادهایی نظیر شورای امنیت در تضمین اجرای احکام تحلیل شده است. این مقاله نشان می‌دهد که وابستگی محاکم بین‌المللی به همکاری دولت‌ها و حمایت نهادهای بین‌المللی از جمله شورای امنیت، یکی از چالش‌های اصلی در ضمانت اجرایی آرای این محاکم است. در عین حال، محاکم بین‌المللی با تبیین اصول حقوقی نوین و رسیدگی به جرایم بین‌المللی توانسته‌اند نقشی مهم در توسعه حقوق بین‌الملل ایفا کنند. در پایان، پیشنهادهایی برای تقویت سازوکارهای اجرایی، ارتقای همکاری‌های بین‌المللی، و کاهش تأثیر ملاحظات سیاسی ارائه شده است که می‌تواند به افزایش اثربخشی ضمانت اجرایی و تقویت نظام عدالت بین‌المللی کمک کند.</p> https://www.csjlp.org/index.php/csjlp/article/download/298/389
