Journal Article 2024 03 04 <p>Inflation is one of the influential economic and social phenomena that some governments, which lack the ability to control it, sometimes describe as a structural issue. Although inflation is typically examined as a key variable in macroeconomics, in the absence of effective regulatory measures, it turns into a critical issue referred to as an "inflationary economy." The government plays a central role in either curbing or exacerbating inflation. Governmental actions, whether through legislation and regulation or through executive conduct, can give rise to an inflationary economy. The purpose of the present study is to investigate whether civil liability for compensating the costs resulting from an inflationary economy is conceivable under the jurisprudential principles of la zarar (no harm) and justice and equity. This study, conducted using a descriptive-analytical method and based on library resources, concludes that considering the government's role in Iran's economy and referring to the principles of la zarar, justice, and equity in Iranian law, the answer to the above question is affirmative.</p> <p>یکی از پدیده­های مؤثر اقتصادی و اجتماعی که بعضاً دولت­هایی که توانایی کنترل آن را ندارند از آن به عنوان پدیده­ای ساختاری تعبیر می­کنند، تورم است. تورم یکی از مؤلفه­های مورد بررسی در اقتصاد کلان است لکن زمانیکه تدبیر مؤثری برای کنترل آن وجود نداشته باشد، تبدیل به معضلی به نام اقتصاد تورم­زا می­شود. دولت بازیگر اصلی در کنترل تورم یا تشدید آن است. اعمال دولت هم در وضع قانون و مقرره و هم در اعمال تصدی، می­تواند اقتصاد تورم­زا را بیافریند. هدف از پژوهش حاضر، بررسی این امر است که مسئولیت مدنی در جبران هزینه­های ناشی از اقصاد تورم­زا در پرتوی قاعده فقهی لاضرر و عدل و انصاف قابل تصور است یا خیر؟ در این پژوهش که به روش توصیفی-تحلیلی و با استفاده از منابع کتابخانه­ای حاصل شده، به این نتیجه رسیدیم که با توجه به نقش دولت در اقتصاد ایران و با استناد به قاعده لاضرر، عدل و انصاف در حقوق ایران، پاسخ به پرسش بالا، مثبت است.</p> https://www.csjlp.org/index.php/csjlp/article/download/313/263
