One of the types of liability in the field of law is legal liability. This form of liability pertains to the financial and legal relations of individuals and is divided into two main categories: contractual liability and non-contractual liability. It appears that the extinction of individuals’ legal liability in Iranian law is limited to specific grounds. Accordingly, in Iranian law, if legal liability is imposed on an individual under special circumstances, or if due to particular conditions its fulfillment becomes impossible, or can only be carried out with extreme difficulty, the legal liability of individuals may be extinguished. Recent findings in medical research and advances in empirical sciences indicate that women’s special physical conditions in their monthly biological cycle to some extent affect their performance. This study, conducted using a descriptive-analytical method and library resources, seeks to answer the question of whether women’s physical condition may influence the extinction of their legal liability and whether it can be considered a new instance of the causes for the extinction of legal liability. The findings of this research suggest that, in response to this question, first, a distinction must be made between the various situations in which legal liability arises for individuals. Second, women’s particular physical condition can only be regarded as a ground for extinguishing liability in cases where either (a) at the time of contract conclusion, the individual was under the influence of intolerable duress caused by her physical condition, or (b) when the fulfillment of the obligation is contingent upon performance within a specific timeframe, and during this period, the occurrence of particular physical conditions in women results in the performance of the obligation being accompanied by extreme hardship.</p> <p>زمانی­که مسئولیت در عالم حقوق برای اشخاص به وجود آمد، اصل بر این است که نسبت به مسئولیت پاسخگو باشند. یکی از انواع مسئولیت­ها در عالم حقوق، مسئولیت حقوقی است. این نوع از مسئولیت به روابط مالی و حقوقی اشخاص بازگشته و خود به دو قسم کلی مسئولیت قراردادی و مسئولیت غیرقراردادی تقسیم می­شود. به نظر می­رسد که زوال مسئولیت حقوقی اشخاص در حقوق ایران، منحصر به عناوین خاصی است. بر همین اساس نیز در حقوق ایران، چنانچه مسئولیت حقوقی تحت شرایط خاصی بر ذمه شخص قرار گرفته یا در اثر شرایط خاصی ایفای آن ناممکن شده یا تنها با سختی بسیار زیاد، ایفای مسئولیت امکان­پذیر باشد، ممکن است مسولیت حقوقی اشخاص با زوال روبرو شود. نتایج مطالعات جدید پزشکی و پیشرفت علوم تجربی، نشان­دهنده این امر است که شرایط خاص جسمانی بانوان در چرخه زیستی ماهیانه ایشان تا حدودی بر عملکرد آن‌ها اثرگذار است. در این پژوهش که به روش توصیفی-تحلیلی و با استفاده از منابع کتابخانه­ای انجام شده است، به دنبال یافتن پاسخ این سوال هستیم که ممکن است وضعیت جسمانی بانوان بر زوال مسئولیت حقوقی آنان تأثیرگذار بوده و بتوان آنرا مصداقی جدید از اسباب زوال مسئولیت حقوقی شناخت یا خیر؟ یافته­های پژوهش اخیر حاکی از این امر است که در پاسخ بدین سوال اولاً باید میان فروض مختلفی که مسئولیت حقوقی را برای اشخاص ایجاد می­کند قائل به تفکیک شد. در ثانی وضعیت خاص جسمانی بانوان تنها در شرایطی می­تواند مصداقی از یکی از عناوین منحصر زایل کننده مسئولیت به شمار رود که یا شخص در هنگام انعقاد قرارداد تحت تأثیر اکراه غیرقابل تحمل ناشی از وضعیت جسمانی خود قرار گرفته باشد یا در حالتی که ایفای تعهد، منوط به اجرا در بازه زمانی مشخصی بوده و در این مدت زمانی، وقوع شرایط جسمانی خاصی بر بانوان، ایفای تعهد را با مشقت فراوان برای ایشان همراه کند.</p> https://www.csjlp.org/index.php/csjlp/article/download/318/339
