Journal Article 2024 11 21 <p>International law is a system formed on the basis of the will of states, and states are still considered the primary actors of this system. Although various entities and institutions emerged within the international legal system in the twentieth century, they have nonetheless failed to achieve a status comparable to that of states. Therefore, states constitute the main pillar of the international community; they possess full legal capacity, meaning the ability to acquire diverse rights, powers, and obligations. This study was conducted using a descriptive-analytical approach, aiming to examine the role of non-state actors in the development and revision of the rules and regulations of international law. The results demonstrated that, despite the active participation of certain non-state actors in the formation and implementation of international rules, international law has not recognized international legal personality for non-state actors beyond that of subjects of this legal system.</p> <p>حقوق بین‌الملل نظامی است که بر پایه اراده دولت‌ها شکل‌گرفته و دولت‌<strong>‌ها </strong>کماکان بازیگر اصلی این نظام قلمداد می‌شوند. هرچند در قرن بیستم موجودیت<strong>‌ها </strong>و نهاد<strong>‌های </strong>مختلفی در نظام حقوق بین‌الملل سر برآورده ‌اند، با این ‌وجود هنوز نتوانسته‌ اند به جایگاهی همچون جایگاه دولت دست یابند؛ بنابراین دولت‌<strong>‌ها </strong>ستون اصلی جامعه بین‌المللی را تشکیل می‌دهند؛<strong> آن‌ها </strong>از اهلیت حقوقی کامل، یعنی توانایی در اختیار گرفتن حقوق، اختیارات و تعهدات گوناگون برخوردارند. این پژوهش به روش رویکردی توصیفی ـ تحلیلی و با هدف بررسی نقش بازیگران غیردولتی در توسعه و بازنگری قواعد و مقررات حقوق بین‌الملل انجام شد. نتایج نشان داد که حقوق بین‌الملل علی ‌رغم مشارکت فعال برخی از بازیگران غیردولتی در شکل‌گیری و اجرای قواعد بین‌المللی، شخصیت حقوقی بین‌المللی در حد تابعان این حقوق را برای بازیگران غیردولتی شناسایی نکرده است.</p> https://www.csjlp.org/index.php/csjlp/article/download/333/279
