Journal Article 1404/04/09 <p>Women, as half of society, occupy a special and significant position. Accordingly, in national and international legal and jurisprudential discourse, laws have been enacted concerning their status, obligating states to implement them. The aim of this descriptive–analytical research is to examine the effects of securing women’s rights in Islam and international human rights instruments. The method of data collection was library-based, and the required tool was note-taking. The findings revealed that both Islam and international human rights instruments have established regulations for securing women’s rights. Although these laws have been enforced, there still remain limitations and deficiencies regarding women’s rights, including gender discrimination, employment restrictions, inheritance, blood money (diyah), and other issues. To prevent such limitations, national and international laws with legal gaps must be amended, and the opinions of Islamic jurists should be considered in this regard. Furthermore, steps should be taken toward adopting newer and more precise legislation concerning the realization of women’s rights. By recognizing the qualifications and abilities of women in various political, cultural, social, and economic spheres, it can be expected that a country will achieve sustainable development. Historically, women have proven their capabilities; today, their presence in economic markets, the cabinet, the Islamic Consultative Assembly (Parliament), and their roles in the educational system and within families demonstrate women’s competence across diverse fields.</p> <p>زنان به عنوان نیمی از افراد جامعه از جایگاه ویژه‌ای برخوردارند. به‌طوری که در مباحث فقهی و حقوقی ملی و بین‌المللی نسبت به آن‌ها قوانینی مصوب شده است و دولت‌ها را ملزم به اجرای آن کرده است. هدف پژوهش توصیفی- تحلیلی حاضر بررسی آثار احقاق حقوق زنان در اسلام و اسناد بین‌المللی حقوق بشر است. روش گردآوری اطلاعات کتابخانه‌ای و ابزار موردنیاز فیش‌برداری بود. نتایج نشان داد که در اسلام و اسناد بین‌المللی حقوق بشر قوانینی را برای احقاق حقوق زنان مصوب کرده‌اند. هرچند این قوانین اجرا شده است، اما بازهم محدودیت‌ها و کاستی‌هایی در خصوص حقوق زنان از جمله تبعیض جنسیت، محدودیت‌های اشتغال، ارث، دیه و... وجود دارد. برای جلوگیری از این محدودیت‌ها باید قوانین گذشته ملی و بین‌المللی که دارای خلاءهای قانونی است اصلاح گردد و بیانات فقهیان در این زمینه مورد توجه قرار گیرد. همچنین با تصویب قوانین جدید‌تر و دقیق‌تر در خصوص احقاق حقوق زنان قدم برداشت. اگر به شایستگی‌ها و توانایی‌های زنان در عرصه‌های مختلف سیاسی، فرهنگی، اجتماعی و اقتصادی توجه شود، می‌توان انتظار داشت که کشور به توسعه پایدار می‌رسد. زنان از دیرباز توانایی‌های خود را به همگان به اثبات رسانده‌اند، به‌طوری امروزه حضور زنان در بازارهای اقتصادی، کابینه دولت، مجلس شورای اسلامی، نقش آن‌ها در آموزش کشور و خانواده نشان‌دهندۀ شایستگی‌های زنان در عرصه‌های مختلف می‌باشد.</p> https://www.csjlp.org/index.php/csjlp/article/download/355/340
