Initially, the concept and nature of prisoners' rights within the Islamic framework and its jurisprudential foundations are examined. Ayatollah Behjat's theory, emphasizing human dignity, justice, and the reform and rehabilitation of prisoners, is then analyzed. The article proceeds to compare this theory with the views of other Islamic jurists, highlighting its strengths and weaknesses. Furthermore, the article examines the similarities and differences between Ayatollah Behjat's theory and the Islamic Penal Code of Iran. Finally, recommendations are made for improving the Islamic Penal Code in regard to prisoners' rights. The findings suggest that Ayatollah Behjat's emphasis on human dignity and the reform of prisoners could serve as an effective basis for enhancing the legal framework concerning prisoners' rights within Iran's legal system.</p> <p>این مقاله به بررسی و نقد نظریه‌ی آیت‌الله محمدتقی بهجت درباره‌ی حقوق زندانیان و تطبیق آن با قانون مجازات اسلامی ایران می‌پردازد. در ابتدا، مفهوم و ماهیت حقوق زندانیان از منظر اسلامی و مبانی فقهی آن مورد بررسی قرار می‌گیرد. سپس نظریه‌ی آیت‌الله بهجت، با تمرکز بر اصول کرامت انسانی، عدالت، و اصلاح و تربیت زندانیان، تحلیل می‌شود. در ادامه، این نظریه با دیدگاه‌های دیگر فقها مقایسه شده و نقاط قوت و ضعف آن مورد بررسی قرار می‌گیرد. همچنین، این مقاله به تطبیق نظریه‌ی آیت‌الله بهجت با قانون مجازات اسلامی ایران پرداخته و شباهت‌ها و تفاوت‌های موجود بین آن‌ها را بررسی می‌کند. در نهایت، پیشنهاداتی برای بهبود قانون مجازات اسلامی در زمینه‌ی حقوق زندانیان ارائه می‌شود. نتایج این بررسی نشان می‌دهد که نظریه‌ی آیت‌الله بهجت با تأکید بر کرامت انسانی و اصلاح زندانیان، می‌تواند به‌عنوان مبنایی مؤثر برای بهبود قوانین مرتبط با حقوق زندانیان در نظام حقوقی ایران مورد استفاده قرار گیرد.</p> https://www.csjlp.org/index.php/csjlp/article/download/38/21
