The study explores the perspectives of these two prominent scholars on individual, social, cultural, and economic rights and examines their influence on various constitutional principles. Ayatollah Makarem Shirazi emphasizes social justice and human rights, focusing on the formulation of social and political rights, while Ayatollah Javadi Amoli, with a more philosophical approach, elucidates fundamental rights based on rational and religious principles. The article also investigates the similarities and differences between their theories, their impact on the post-Islamic Revolution legal system of Iran, and offers suggestions for improving citizens' fundamental rights in the Constitution.</p> <p>این مقاله به بررسی تطبیقی نظریات آیت‌الله ناصر مکارم شیرازی و آیت‌الله عبدالله جوادی آملی در مورد حقوق اساسی شهروندان و تأثیر این نظریات بر قانون اساسی جمهوری اسلامی ایران می‌پردازد. در این پژوهش، دیدگاه‌های دو فقیه بزرگ در زمینه حقوق فردی، اجتماعی، فرهنگی و اقتصادی مورد تحلیل قرار گرفته و تأثیرات آن‌ها بر اصول مختلف قانون اساسی بررسی می‌شود. آیت‌الله مکارم شیرازی با تأکید بر عدالت اجتماعی و حقوق بشر، به تدوین حقوق اجتماعی و سیاسی پرداخته، در حالی که آیت‌الله جوادی آملی با رویکردی فلسفی‌تر، به تبیین حقوق اساسی بر مبنای اصول عقلانی و دینی پرداخته است. این مقاله همچنین به بررسی شباهت‌ها و تفاوت‌های نظریات این دو فقیه و تأثیرات آن‌ها بر شکل‌گیری نظام حقوقی پس از انقلاب اسلامی ایران می‌پردازد و پیشنهاداتی برای بهبود حقوق اساسی شهروندان در قانون اساسی ارائه می‌دهد.</p> https://www.csjlp.org/index.php/csjlp/article/download/39/22
