Journal Article 2024 12 22 <p>Air pollution at the local, national, and international levels causes significant harm to both the human and natural environment. Today, environmental protection has become such a prominent moral and social value that it necessitates criminal protection. In this context, the insufficiency of civil liability guarantees and the inadequacy of administrative legal measures have reinforced the need for stronger legal mechanisms. However, criminal law interventions aimed at environmental protection require careful consideration of specific principles, without which the success of such legal protections cannot be assured. Civil rights are privileges granted to a country's citizens within its borders, but environmental civil rights cannot be confined by borders, as the environment transcends national boundaries. From this perspective, particular attention must be paid to the principles and foundations of human rights, which also encompass civil rights. Accordingly, the perpetrator of an act causing pollution is regarded as a violator of both environmental human rights and civil rights. This article examines the issue of polluted fuels as one of the contributing factors to environmental pollution, analyzing it from the standpoint of international law, international legal practices, and relevant judicial rulings.</p> <p>آلودگی­های هوا در سه سطح داخلی، ملی و بین المللی،آثار زیانباری بر محیط زیست انسانی و طبیعی بر جای می­گذارند. امروزه محیط زیست وحفاظت از آن،آنچنان به ارزش اخلاقی و اجتماعی تبدیل شده است که حمایت کیفری ازآن ضروری می­نماید. دراین راستا ضعف ضمانت­های حقوق مسئولیت مدنی وعدم کفایت تدابیر حقوق اداری، راتقویت می­کنند. با این حال اقدامات حقوق کیفری برای حمایت ازمحیط زیست مستلزم ملاحظه بایسته­هایی است که بدون توجه به آن‌ها نمی­توان به توفیق این حقوق امید بست. حقوق شهروندی یک امتیاز است که به اتباع کشور در محدوده مرزها داده می­شود، ولی حقوق شهروندی از دیدگاه محیط زیست را نمی­توان محدود به مرز نمود؛ زیرا محیط زیست مرزها را درمی­نوردد. از این منظر، باید به اصول و مبانی حقوق بشر توجه خاص معطوف داشت که حقوق شهروندی را نیز در بر می­گیرد. بر این اساس، فاعل فعل آلوده کننده را ناقض حقوق زیست محیطی بشر و شهروندی می‌نامند. در این مقاله به بررسی موضوع سوخت­های آلوده به عنوان یکی از عوامل آلاینده محیط زیست می­پردازیم و آن را از منظر حقوق بین­الملل و رویه­های بین­المللی و آرای صادره مورد بررسی و تحلیل قرار خواهیم داد.</p> https://www.csjlp.org/index.php/csjlp/article/download/405/272
