Journal Article 2023 04 16 <p>This paper aims to examine the concept and characteristics of ownership and the privileges that an owner possesses concerning their property while also identifying the limitations imposed on ownership in relation to social rights and public order. While emphasizing individuals' proprietary rights over their possessions and the necessity of respecting them, this study addresses the conflict between the rights of land and property owners and the implementation of governmental and municipal development projects. It specifically focuses on land use regulations, the process of purchasing and expropriating such properties, and the legal rights arising from these transactions, all analyzed through the lens of existing legislation and judicial rulings. The article also explores the implications of urban planning projects, which impose obligations on the government and municipalities regarding project execution, naturally leading to necessary actions and formal procedures for the expropriation of properties within such plans. The central concern of this study is the legal rights conferred upon property owners when their lands are designated for public, developmental, or military projects, the limitations on the government’s authority in executing such plans, and the necessity for adherence to legal obligations governing expropriation. Moreover, it underscores the sanctity of ownership, emphasizing that an individual's property holds the same inviolability as their personal dignity.</p> <p>این نوشته در صدد است ضمن بررسی مفهوم و اوصاف مالكیت و امتیازاتی كه مالك نسبت به ملك خود از آن برخوردار است، محدودیت‌هایی كه مالكیت از حیث مواجهه با حقوق و نظم اجتماعی با آن مواجه است را بازشناسی كند و ضمن اصرار بر حقوق مالكانه اشخاص نسبت به مایملك خود و احترام به آن، مسئله برخورد حقوق مالكین اراضی و املاك واقع در طرح‌های دولتی و شهرداری‌ها را با تكیه بر موضوع كاربری اراضی واقع در طرح و نحوة خرید و تملك این املاك و حقوق ناشی از آن را با استفاده از قوانین جاری و آراء صادره مورد توجه و بررسی قرار دهد. در این مقاله آثار ناشی از طرح‌های شهری كه در نتیجه آن، تكالیفی بر عهده دولت و شهرداری‌ها در خصوص اجرای طرح و طبعاً اقدامات و تشریفات لازم در خصوص تملك املاك واقع در طرح را ایجاد می‌كند، مورد بحث و بررسی قرار می‌گیرد. حقوقی كه در نتیجه‌ی وقوع املاك اشخاص در طرح‌های عمومی، عمرانی و نظامی دولت برای مالكین ایجاد می‌شود و محدودیت اختیارات دولت در خصوص اجرای طرح و لزوم پایبندی دولت به تكالیف ناشی از قوانین ناظر به موضوع و حرمت مالكیت و اینكه مال و ملك مؤمن همچون آبروی اوست، دغدغه‌ اصلی این نوشتار است.</p> https://www.csjlp.org/index.php/csjlp/article/download/411/245
