Journal Article 1403/11/06 <p>Within the consequences of legal science in the various stages of legislation, interpretation of the law, and enforcement of legal rules, the stage of efficiency and utility becomes the subject of discussion, opinion, and study. In the legislative stage—namely, lawmaking—the debate centers on utility or efficiency. Following enactment comes the stage of interpretation, while the enforcement stage falls outside the scope of the present discussion. The interpretation stage can be attributed to either an individual or an institution. Personal interpretation, whether by legal scholars or judges, although not in itself a formal source of law, can nonetheless be effective, influential, and even decisive. Judicial interpretation, however, if rendered collectively and in the framework of judicial precedent (unifying opinions), can have significant impact, particularly in bringing civil law systems and common law systems closer together. In this article, the author, employing a descriptive–analytical method, has elaborated on this subject.</p> <p>در پیامدهای دانش حقوق در مراحل مختلف وضع قانون، تفسیر قانون و اجرای قواعد حقوقی مرحله کارایی و مطلوبیت محل بحث و نظر و مطالعه قرار می‌گیرد. در محله وضع یعنی قانونگذاری به بحث مطلوبیت یا کارایی اشاره می‌شود. پس از وضع نوبت تفسیر است و مرحله اجراء از دایره شمول بحث نگارنده این سطور خارج است. مرحله تفسیر را می‌توان به شخص یا سازمان منتسب دانست. تفسیر شخصی چه از طرف حقوق دانان و چه از سوی قضات اگرچه به صورت فردی از منابع حقوق نیست اما می‌تواند مثمر ثمر و همچنین منشا اثر و تعیین کننده باشد. تفسیر ارائه شده از سوی قضات اما اگر به صورت گروهی و در حوزه آراء وحدت رویه قضایی باشد می‌تواند منشا اثر بوده و این موضوع به ویژه نظام‌های حقوقی رومی ژرمنی و کامن لا را به هم نزدیک ساخته است. در این مقاله نگارنده به شیوه توصیفی تحلیلی به تشریح این موضوع اشاره داشته است.</p> https://www.csjlp.org/index.php/csjlp/article/download/417/349
