Islamic jurisprudence, as one of the primary sources of legislation in Islamic countries, has a significant impact on their criminal law systems. This research reviews the historical background of criminal law in Arab countries and Iran, analyzes the role and position of Islamic jurisprudence in these systems, and examines its application and enforcement in criminal laws. The study further explores the similarities and differences in the implementation of Islamic jurisprudence in Iran and Arab countries from a comparative perspective. The findings indicate that despite the extensive commonalities in the principles of Islamic jurisprudence, there are notable differences in its application within the legal systems of Iran and Arab countries, influenced by divergent jurisprudential interpretations and cultural and social factors. This article also addresses the challenges and opportunities faced by Islamic legal systems in adapting to contemporary conditions and offers recommendations for improving criminal laws.</p> <p>این مقاله به بررسی و تحلیل تطبیقی نقش فقه اسلامی در حقوق کیفری ایران و کشورهای عربی می‌پردازد. فقه اسلامی به عنوان یکی از منابع اصلی قانون‌گذاری در کشورهای اسلامی، تأثیر بسزایی بر نظام‌های حقوق کیفری این کشورها دارد. این تحقیق با بررسی تاریخچه حقوق کیفری در کشورهای عربی و ایران، به تحلیل نقش و جایگاه فقه اسلامی در این نظام‌ها پرداخته و موارد تطبیق و اجرای آن را در قوانین کیفری این کشورها مورد بررسی قرار می‌دهد. در ادامه، شباهت‌ها و تفاوت‌های موجود در نحوه اجرای فقه اسلامی در ایران و کشورهای عربی از منظر تطبیقی بررسی می‌شود. نتایج این تحقیق نشان می‌دهد که با وجود اشتراکات گسترده در اصول فقه اسلامی، تفاوت‌های مهمی در نحوه اجرای این اصول در نظام‌های حقوقی ایران و کشورهای عربی وجود دارد که ناشی از تفاوت‌های فقهی و تأثیرات فرهنگی و اجتماعی است. این مقاله همچنین به بررسی چالش‌ها و فرصت‌های پیش‌روی نظام‌های حقوقی اسلامی در تطبیق با شرایط معاصر می‌پردازد و پیشنهاداتی برای بهبود قوانین کیفری ارائه می‌دهد.</p> https://www.csjlp.org/index.php/csjlp/article/download/42/25
