Journal Article 1403 01 19 <p>This study aims to conduct a comparative analysis of instances of negligent criminal liability in the legal systems of Iran and England. The research follows a descriptive-analytical method, utilizing library sources and online databases. In this study, in addition to presenting specific instances, the role of criminal liability for reckless and careless actions in Iranian and English law is examined. Subsequently, the role of criminal liability for omissions resulting from negligence in Iranian and English law is analyzed. Finally, the role of the elements of imprudence and inadvertence in establishing negligent criminal liability in the legal systems of Iran and England is discussed. The findings indicate that "negligent criminal liability" does not exhibit significant differences between the criminal systems of Iran and England. However, there is also no substantial similarity in this regard between the two legal systems, as both have shown limited inclination toward expanding negligent liability and its instances.</p> <p>این پژوهش با هدف بررسی تطبیقی مصادیق مسئولیت کیفری مسامحه‌ای در دو نظام حقوقی ایران و انگلستان انجام شد. روش تحقیق توصیفی – تحلیلی با استفاده از منابع کتابخانه‌ای و بانک‌های اطلاعاتی بود. در این پژوهش ضمن ارائه مصادیق، نقش مسوولیت کیفری فعل بی‌احتیاطی و بی‌پروایی در حقوق ایران و انگلیس مورد بررسی قرار گرفت. سپس نقش مسوولیت کیفری ترک فعل ناشی از مسامحه در حقوق ایران و انگلیس تحلیل شد و در پایان نقش عنصر بی‌مبالاتی و غفلت در تحقق مسوولیت کیفری مسامحه‌ای در حقوق ایران و انگلستان ارائه گردید. در واقع نتایج نشان داد «مسئولیت کیفری مسامحه‌ای» در نظام کیفری ایران و انگلستان دارای تفاوت چندانی نبوده اما شباهتی در این زمینه بین نظام کیفری دو کشور وجود دارد و هر دو، تمایل زیادی برای گسترش مسئولیت مسامحه‌ای و مصادیق آن از خود نشان نداده‌اند.</p> https://www.csjlp.org/index.php/csjlp/article/download/428/384
