Journal Article 2025 01 13 <p>Transforming commercial litigation without considering the laws of advanced countries in the field of legislation will not be feasible, and this is also true regarding commercial laws in Iran. In recent years, a bill entitled the Commercial Procedural Code has been presented to the Parliament by the Cabinet, which introduces innovations in the field of commercial litigation. Among these innovations are the establishment of commercial courts, the adoption of electronic litigation, the significance of electronic evidence and documents in commercial litigation, the use of commercial advisors in litigation, and the transformation of bankruptcy dispute resolution, among others. Most of the provisions in this bill are derived from the French Civil Procedure Code, and the legislator's aim in this regard is to guarantee the principles of commercial litigation in accordance with updated international laws. Therefore, the aim of this study is to conduct a comparative analysis of the developments in the Commercial Procedural Code Bill with an emphasis on French law using an analytical-descriptive and comparative method. The findings indicate that despite legislative developments, the Commercial Procedural Code Bill ensures the principles of commercial litigation and aligns with the rules of advanced countries in the field of trade. There are also similarities and differences in the legislation of Iran and France in this regard.</p> <p>متحول نمودن دادرسی تجاری بدون در نظر داشتن قوانین کشورهای پیشرفته در عرصه قانونگذاری ممکن نخواهد بود و این موضوع در خصوص قوانین تجاری در ایران نیز محرز است. در سال‌های اخیر لایحه‌ای تحت عنوان لایحه آیین دادرسی تجاری از سوی هیأت دولت، تقدیم مجلس گردیده که نوآوری‌هایی در عرصه­ی دادرسی تجاری به چشم می­آید که از جمله این نوآوری‌ها را می­توان در تشکیل دادگاه‌های تجاری، پرداختن به دادرسی الکترونیکی و اهمیت ادله و اسناد الکترونیکی در دادرسی‌های تجاری، استفاده از مشاوران تجاری در دادرسی‌ها، تحول در شیوه رسیدگی به دعاوی ورشکستگی و... را می­توان به عنوان تحولات حاکم بر لایحه مزبور عنوان نمود. اکثر مقرره‌های موجود در عرصه تحولات لایحه مذکور، متخذ از آیین دادرسی مدنی فرانسه است و هدف قانونگذار در این زمینه را می‌توان تضمین اصول دادرسی تجاری مطابق قوانین به روز جهانی عنوان داشت. از این رو هدف نگاره پیش رو بررسی تطبیقی تحولات حاکم بر لایحه آیین دادرسی تجاری با تأکید بر حقوق فرانسه به روش تحلیلی-توصیفی و تطبیقی است که به این یافته اشاره دارد که لایحه آیین دادرسی تجاری به رغم تحولات تقنینی، تضمین کننده اصول دادرسی تجاری و همسو بودن با قواعد کشورهای پیشرفته در عرصه تجارت قلمداد شده است و از جهاتی تشابهات و تفاوت‌هایی در قانونگذاری ایران و فرانسه در این زمینه قابل مشاهده است.</p> https://www.csjlp.org/index.php/csjlp/article/download/436/269
