The main objective of this study is to answer the question: Considering international law rules and the jurisprudence of international courts, particularly the European Court of Human Rights, under what criteria and conditions can violations of international obligations, especially in the field of human rights, be attributed to third-party states in the territory of unrecognized entities? In this regard, using a descriptive-analytical method, the responsibility of third-party states, the attribution of acts to third-party states, the type of control exerted by third-party states, and the jurisdiction of the adjudicating court are analyzed from the perspective of international law and the jurisprudence of the European Court of Human Rights. The results indicate that certain measures, such as overall control and effective control, have faced challenges and have not been able to adequately safeguard human rights.</p> <p>موضوع مسئولیت­پذیری دولت ثالث در قلمروی موجودیت­های شناسایی نشده موضوعی است که در محاکم بین المللی و رویه دولت­ها مورد توجه قرار گرفته است. هدف اصلی پژوهش حاضر پاسخ به این پرسش است که؛ با توجه به قواعد حقوق بین­الملل و ملاحظه رویه دادگاه­های بین­المللی به­خصوص دیوان اروپایی حقوق بشر، بر اساس چه معیارها و شرایطی می­توان نقض­ تعهدات بین­المللی را به­ویژه در حوزه حقوق بشر در قلمروی موجودیت­های شناسایی نشده را به دولت­ ثالث منتسب نمود. در این راستا و با روش توصیفی،تحلیلی، ضمن تأملی بر مسئولیت دولت ثالث، قابلیت انتساب اعمال به دولت ثالث، نوع کنترل دولت ثالث و صلاحیت دادگاه رسیدگی کننده از منظر حقوق بین­الملل و رویه دیوان اروپایی حقوق بشر تحلیل شده است. نتایج نشان می­دهد؛ که برخی از تدابیر، به مانند کنترل کامل و کنترل موثر، در مواجهه با چالش­ها نتوانسته­اند­؛ به­طور مناسب، از حقوق بشر صیانت به­عمل آورند.</p> https://www.csjlp.org/index.php/csjlp/article/download/443/268
