These differences have, in certain cases, led to challenges in aligning domestic laws with Iran’s international commitments. This issue has rendered the harmonization of spousal rights a necessity. The harmonization of the rights and duties of spouses in Iran's legal framework with international conventions is one of the critical discussions in the domains of human rights and social justice. In recent years, the globalization of law and increased international interactions have heightened the need to reform and adapt domestic laws to international standards. In this context, assessing the necessity of such harmonization from the perspectives of protecting women's rights, preserving the institution of family, and promoting social justice assumes special importance. Accordingly, the objective of this study is to investigate the necessity of harmonizing the rights and duties of spouses in Iran's legal system with international conventions. This research adopts a descriptive-analytical approach and utilizes documentary and library-based sources to examine international instruments, domestic laws, and relevant legal theories. The findings of the study indicate that the globalization of human rights necessitates the revision of domestic legislation and its alignment with international norms, as such alignment strengthens the institution of family and enhances its stability. One of the most crucial steps in this process is the harmonization of spousal rights and duties, which can contribute to reducing violence against women and establishing social justice. Furthermore, the adoption of international principles in this area, while mitigating gender inequalities, reinforces the notion of global citizenship and expands international cooperation. Convergence with international standards not only elevates Iran’s standing in the field of human rights but also reinforces the country’s international obligations.</span></p> <p>در نظام حقوقی ایران، حقوق و تکالیف زوجین بر مبنای فقه اسلامی و قوانین مدنی تعریف شده است، درحالی‌که کنوانسیون‌های بین‌المللی به برابری حقوق زن و مرد تأکید دارند. این تفاوت‌ها در برخی موارد به ایجاد چالش‌هایی در هماهنگی میان قوانین داخلی و تعهدات بین‌المللی ایران منجر شده است که همین موضوع یکسان سازی حقوق زوجین را به یک ضرورت تبدیل نموده است. یکسان‌سازی حقوق و تکالیف زوجین در نظام حقوقی ایران با کنوانسیون‌های بین‌المللی یکی از مباحث مهم حقوق بشر و عدالت اجتماعی است. در سال‌های اخیر، روند جهانی‌شدن حقوق و افزایش تعاملات بین‌المللی موجب شده است که ضرورت اصلاح و تطبیق قوانین داخلی با معیارهای بین‌المللی بیش از پیش مورد توجه قرار گیرد. در این میان، بررسی ضرورت چنین یکسان‌سازی‌ای از منظر حمایت از حقوق زنان، حفظ نهاد خانواده و ارتقای عدالت اجتماعی اهمیت ویژه‌ای دارد، بر همین اساس، هدف این پژوهش، بررسی ضرورت یکسان‌سازی حقوق و تکالیف زوجین در نظام حقوقی ایران با کنوانسیون‌های بین‌المللی است. این پژوهش با رویکرد توصیفی-تحلیلی و با استفاده از منابع اسنادی و کتابخانه‌ای به بررسی اسناد بین‌المللی، قوانین داخلی و نظریات حقوقی مرتبط می‌پردازد.  یافته‌های پژوهش نشان می‌دهد که، جهانی‌شدن حقوق بشر مستلزم اصلاح قوانین داخلی و هماهنگی آن‌ها با موازین بین‌المللی است، چراکه این امر موجب تقویت نهاد خانواده و افزایش ثبات آن می‌شود. یکی از مهم‌ترین گام‌ها در این مسیر، یکسان‌سازی حقوق و تکالیف زوجین است که می‌تواند به کاهش خشونت علیه زنان و برقراری عدالت اجتماعی کمک کند. همچنین، پذیرش اصول بین‌المللی در این زمینه، ضمن کاهش نابرابری‌های جنسیتی، مفهوم شهروند جهانی را تقویت کرده و تعاملات بین‌المللی را گسترش می‌دهد. همگرایی با استانداردهای بین‌المللی نه‌تنها موجب ارتقای جایگاه ایران در عرصه حقوق بشر خواهد شد، بلکه تعهدات بین‌المللی کشور را نیز مستحکم‌تر می‌سازد.</p> https://www.csjlp.org/index.php/csjlp/article/download/510/334
