    <Abstract>&lt;p&gt;The immunity of state officials, particularly heads of state, constitutes one of the most significant obstacles to the prosecution and punishment of perpetrators of international crimes. With the establishment of the International Criminal Court (ICC), considerable efforts have been undertaken to combat impunity and to restrict the scope of such immunities. However, this matter still faces challenges that require further discussion and examination. The purpose of the present article is to analyze the following crucial question: what are the challenges in addressing the immunity of state officials, and what are the possible solutions to these challenges from the perspective of the practice of the ICC? This article is descriptive-analytical in nature and relies on a library-based research method to examine the question at hand. The findings indicate that the lack of cooperation by certain states, conflicts with customary international law regarding immunity, and the influence of political considerations on the Court’s performance have all created serious obstacles to the realization of international justice. A prominent example of this situation is the case of Omar al-Bashir, the former President of Sudan, who, despite the issuance of an arrest warrant, managed to travel to various countries without being apprehended. Strengthening international and diplomatic cooperation, ensuring the effective enforcement of ICC rulings, introducing reforms in the Court’s approach to dealing with the immunity of state officials, enhancing political and judicial support for the Court, reinforcing oversight mechanisms for the enforcement of ICC judgments, establishing special teams for pursuing arrests, and raising awareness and providing training to states and domestic institutions are among the most significant recommendations for overcoming the challenges associated with addressing the immunity of state officials, with emphasis on the practice of the International Criminal Court.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;مصونیت مقامات رسمی، به‌ویژه سران کشورها، یکی از مهم‌ترین موانع تعقیب و مجازات مرتکبان جنایات بین‌المللی است. با شکل‌گیری دیوان کیفری بین‌الملی تلاش‌های قابل‌توجهی در جهت مبارزه با بی‌کیفری و محدود ساختن دامنه این مصونیت‌ها صورت گرفته است اما هنوز این امر با چالش‌هایی مواجه است که نیازمند بحث و بررسی است. هدف مقاله حاضر بررسی این سوال مهم است که چالش‌های مقابله با مصونیت مقامات رسمی چیست و راهکارهای مقابله با این چالش‌ها از منظر رویه دیوان کیفری بین‌المللی چیست؟ این مقاله توصیفی تحلیلی است و با استفاده از روش کتابخانه‌ای به بررسی سوال مورد اشاره پرداخته است. یافته‌ها بر این امر دلالت دارد که عدم همکاری برخی کشورها، تعارض با حقوق بین‌الملل عرفی در زمینه مصونیت، و نفوذ ملاحظات سیاسی بر عملکرد دیوان، موجب شده است که اجرای عدالت بین‌المللی با موانع جدی مواجه شود. نمونه بارز این وضعیت، پرونده عمر‌البشیر، رئیس‌جمهور پیشین سودان است که علی‌رغم صدور حکم بازداشت، موفق به سفر به کشورهای مختلف بدون دستگیری شد.&lt;strong&gt; &lt;/strong&gt;تقویت همکاری‌های بین‌المللی و دیپلماتیک، اجرای مؤثر احکام دیوان، اصلاحات در رویکرد دیوان برای مقابله با مصونیت مقامات دولتی، حمایت سیاسی و قضائی بیشتر از دیوان، تقویت نظارت بر اجرای حکم‌های دیوان، ایجاد تیم‌های ویژه برای پیگیری دستگیری‌ها و آگاه‌سازی و آموزش کشورها و نهادهای داخلی از مهمترین پیشنهادات برای رفع چالش‎های مقابله با مصونیت مقامات رسمی با تأکید بر رویه دیوان کیفری بین‌المللی است.&lt;/p&gt;</OtherAbstract>
