Preserving this right for children, who are among the most vulnerable members of society, must be given special attention. However, does this attention have a basis in international institutions? Has Islam, as the most complete religion, considered this right in its teachings and principles? By studying the verses of the Quran and Islamic jurisprudence, it can be understood that the term "right to life" is not explicitly mentioned in Islamic texts. However, considering the severe prohibition and condemnation of killing human beings, especially children, in religious texts, this right and the protection of human life, particularly of children, can be inferred. The Committee on the Rights of the Child has also recognized the right to life as a fundamental principle for children's rights, which must be considered under all circumstances. This article, using a descriptive-analytical approach, not only establishes the right to life of children from the perspective of Islamic jurisprudence and international law but also examines the duties of governments in providing comprehensive protection of children's rights. This includes legislation prohibiting abortion by extending the period of childhood to before birth, the prohibition of the execution of children, the prohibition of torture, and other supportive legislative measures for children.</p> <p>حق حیات از اصلی ترین حقوق هر انسان است.حفظ این حق برای کودکان که در زمره آسیب پذیرترین افراد جامعه هستند باید مورد توجه خاص قرار گیرد. اما آیا توجه به چنین حقی در نهادهای بین المللی مصداقی دارد؟ آیا اسلام به عنوان کامل ترین دین، درتعالیم و مبانی خود به این حق امعان نظر داشته است؟با مطالعه آیات قرآن و فقه اسلامی، می‌توان دریافت که در متون اسلامی عبارت"حق حیات"دیده نمی‌شود اما با توجه به حرمت و قبح شدید کشتن انسان‌ها بویژه کودکان  در متون دینی، می‌توان این حق و حمایت از جان انسان‌ها بویژه کودکان را استنباط نمود. کمیته حقوق کودک نیز در یکی از اصول اساسی خود، حق حیات را به عنوان یک اصل بنیادین بر حقوق کودکان به رسمیت شناخته است که تحت هرشرایط باید مورد توجه قرار گیرد. این مقاله با دیدگاه توصیفی تحلیلی علاوه بر اثبات حق حیات کودکان از منظر فقه اسلام و قوانین بین الملل، وظایف دولت‌ها برای حمایت همه جانبه از حقوق کودکان، از جمله تقنین در زمینه عدم جواز سقط جنین از طریق تسری زمان کودکی به قبل از تولد، عدم جواز اعدام کودکان، ممنوعیت شکنجه و سایر اعمال تقنینی حمایتی برای کودکان، مورد مطالعه قرار می‌دهد. </p> https://www.csjlp.org/index.php/csjlp/article/download/69/49
