    <ArticleTitle>Redefining National Sovereignty in Light of the Responsibility to Protect Doctrine: The Transition from Absolute Sovereignty to Responsible Sovereignty in Contemporary International Law</ArticleTitle>

    <Abstract>&lt;p class="BodyStyle" style="text-align: justify; direction: ltr; unicode-bidi: embed;"&gt;&lt;span lang="EN-GB" style="font-size: 9.0pt; line-height: 115%;"&gt;National sovereignty is a foundational principle of international law that, in its classical formulation, emphasized the supreme authority of the state, political independence, territorial integrity, and the prohibition of intervention in domestic affairs. However, the development of international human rights law, humanitarian law, and international criminal law has transformed the absolute conception of sovereignty. This study aims to explain how national sovereignty has been redefined in light of the Responsibility to Protect doctrine and to examine the transition from absolute to responsible sovereignty. It employs a descriptive-analytical method based on the examination of international instruments, theoretical foundations of sovereignty, and legal scholarship concerning the Responsibility to Protect. The findings indicate that the doctrine does not abolish state sovereignty but reconstructs it as a combination of rights and obligations connected with the protection of populations. Under this framework, each state bears the primary responsibility to protect its population from genocide, war crimes, ethnic cleansing, and crimes against humanity. The international community is expected to assist states through capacity-building, cooperation, and preventive measures and to consider gradual collective action under the United Nations Charter only when a state manifestly fails to fulfil its protective responsibilities. Despite its normative potential, the doctrine faces significant challenges, including selective implementation, double standards, the veto power of permanent Security Council members, the influence of powerful states, and the risk that protective operations may exceed their authorized purposes. The study concludes that the Responsibility to Protect should be regarded as a framework for reconstructing sovereignty rather than eliminating it. The effective realization of responsible sovereignty requires the prioritization of prevention, compliance with necessity and proportionality, collective decision-making, continuous supervision, and accountability for actors implementing international protective measures.&lt;/span&gt;&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;حاکمیت ملی یکی از اصول بنیادین حقوق بین‌الملل است که در برداشت کلاسیک، بر اقتدار عالی دولت، استقلال سیاسی، تمامیت ارضی و منع مداخله در امور داخلی تأکید داشت. بااین‌حال، توسعه حقوق بین‌الملل بشر، حقوق بشردوستانه و حقوق کیفری بین‌المللی، برداشت مطلق از حاکمیت را با تحول مواجه ساخته است. پژوهش حاضر با هدف تبیین چگونگی بازتعریف حاکمیت ملی در پرتو دکترین مسئولیت حمایت و بررسی گذار از حاکمیت مطلق به حاکمیت مسئولانه انجام شده است. روش پژوهش توصیفی ـ تحلیلی و مبتنی بر بررسی اسناد بین‌المللی، مبانی نظری حاکمیت و ادبیات حقوقی مرتبط با مسئولیت حمایت است. یافته‌ها نشان می‌دهد که مسئولیت حمایت، حاکمیت دولت را نفی نمی‌کند، بلکه آن را به مجموعه‌ای از حقوق و تکالیف مرتبط با حمایت از جمعیت تبدیل می‌سازد. بر اساس این دکترین، هر دولت مسئول اصلی حمایت از جمعیت خود در برابر نسل‌کشی، جنایات جنگی، پاک‌سازی قومی و جنایت علیه بشریت است. جامعه بین‌المللی نیز موظف است از طریق مساعدت، ظرفیت‌سازی و اقدامات پیشگیرانه، دولت‌ها را در انجام این مسئولیت یاری کند و تنها در صورت ناکامی آشکار دولت، واکنش جمعی و تدریجی را در چارچوب منشور ملل متحد مورد توجه قرار دهد. با وجود ظرفیت هنجاری این دکترین، اجرای آن با چالش‌هایی مانند کاربرد گزینشی، استانداردهای دوگانه، حق وتو، نفوذ قدرت‌های بزرگ و احتمال فراتر رفتن عملیات از اهداف حمایتی مواجه است. نتیجه پژوهش نشان می‌دهد که مسئولیت حمایت را باید چارچوبی برای بازسازی مفهوم حاکمیت دانست، نه ابزاری برای حذف آن. تحقق حاکمیت مسئولانه مستلزم تقدم پیشگیری، رعایت ضرورت و تناسب، تصمیم‌گیری جمعی، نظارت مستمر و پاسخ‌گویی مجریان اقدامات بین‌المللی است.&lt;/p&gt;</OtherAbstract>
