Journal Article 1405 01 18 <p>Using a descriptive-analytical method and a comparative approach, the present study examines the capacities and challenges of Iran’s legal system in the process of achieving compliance with the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement). To this end, while analyzing the structure of intellectual property law in Iran, the provisions of the 2024 Industrial Property Protection Act are compared with the standards established under the TRIPS Agreement, and the degree of conformity between them is assessed in the areas of patents, trademarks, industrial designs, trade secrets, copyright, and enforcement mechanisms. The findings indicate that, compared with previous legislation, the 2024 Industrial Property Protection Act represents an important step toward bringing Iranian law closer to international standards. Nevertheless, significant deficiencies remain in the areas of copyright and related rights, protection of digital works, enforcement of intellectual property rights, border measures, and specialized remedies and sanctions. Moreover, Iran’s non-membership in the Berne Convention and the World Intellectual Property Organization (WIPO) Internet Treaties constitutes one of the major obstacles to achieving full compliance with the TRIPS Agreement. From an economic perspective, accession to the TRIPS Agreement may simultaneously enhance investment security and facilitate technology transfer, on the one hand, while increasing the costs of access to knowledge and technology, on the other. Consequently, Iran’s accession to the TRIPS Agreement can be development-oriented only if it is accompanied by gradual legal reforms, effective use of the flexibilities available under the Agreement, and strengthened institutional and enforcement infrastructure.</p> <p>پژوهش حاضر با روش توصیفی ـ تحلیلی و رویکرد تطبیقی، به بررسی ظرفیت‌ها و چالش‌های نظام حقوقی ایران در مسیر انطباق با موافقت‌نامه تریپس می‌پردازد. در این راستا، ضمن تحلیل ساختار حقوق مالکیت فکری در ایران، مقررات قانون حمایت از مالکیت صنعتی ۱۴۰۳ با استانداردهای موافقت‌نامه تریپس مقایسه شده و میزان هماهنگی آن‌ها در حوزه‌های اختراعات، علائم تجاری، طرح‌های صنعتی، اسرار تجاری، حق مؤلف و سازوکارهای اجرایی مورد ارزیابی قرار گرفته است. یافته‌های تحقیق نشان می‌دهد که قانون حمایت از مالکیت صنعتی ۱۴۰۳ در مقایسه با قوانین پیشین، گامی مهم در جهت نزدیک‌سازی حقوق ایران به استانداردهای بین‌المللی به شمار می‌رود. با این حال، در حوزه حق مؤلف و حقوق مرتبط، حمایت از آثار دیجیتال، اجرای حقوق، تدابیر مرزی و ضمانت‌اجراهای تخصصی، همچنان کاستی‌های قابل توجهی مشاهده می‌شود. همچنین، عدم عضویت ایران در کنوانسیون برن و معاهدات اینترنتی سازمان جهانی مالکیت فکری، یکی از موانع مهم انطباق کامل با تریپس محسوب می‌شود. در بعد اقتصادی نیز الحاق به تریپس می‌تواند هم‌زمان موجب افزایش امنیت سرمایه‌گذاری و انتقال فناوری از یک‌سو و افزایش هزینه دسترسی به دانش و فناوری از سوی دیگر شود. در نتیجه، الحاق ایران به تریپس تنها در صورتی می‌تواند توسعه‌محور باشد که با اصلاحات تدریجی، بهره‌گیری از انعطاف‌های موافقت‌نامه و تقویت زیرساخت‌های اجرایی همراه شود.</p> https://www.csjlp.org/index.php/csjlp/article/download/815/453
