تحلیل مبانی مسئولیت محض در جبران خسارات ناشی از آلودگی نفتی در حقوق ایران با بررسی تطبیقی کنوانسیون CLC

آلودگیهای زیستمحیطی ناشی از فعالیتهای نفتی، به دلیل پیامدهای گسترده و جبرانناپذیری که بر حیات انسانی، اکوسیستمها و اقتصاد وارد میآورد، از مهمترین چالشهای حقوقی و زیستمحیطی معاصر محسوب میشود. یکی از مبانی مهم در حقوق مسئولیت مدنی برای مقابله با این خسارات، «مسئولیت محض» است که بر خلاف مسئولیت مبتنی بر تقصیر، نیاز به اثبات خطای عامل زیان ندارد و صرف وقوع خسارت و رابطه سببیت برای انتساب مسئولیت کافی است. این رویکرد، در اسناد بینالمللی متعددی از جمله کنوانسیون بینالمللی مسئولیت مدنی برای خسارات آلودگی نفتی (CLC) به صراحت پذیرفته شده است. هدف این مقاله، تحلیل مبانی پذیرش مسئولیت محض در جبران خسارات آلودگی نفتی در حقوق ایران و مقایسه تطبیقی آن با کنوانسیون CLC است. این پژوهش از نوع نظری بوده و با روش توصیفی-تحلیلی و با بهرهگیری از منابع کتابخانهای (شامل قوانین، کتب حقوقی و مقالات علمی) انجام شده است. یافتهها نشان میدهد که اگرچه حقوق ایران به طور صریح و عام قاعده مسئولیت محض را به عنوان مبنای عمومی مسئولیت مدنی نپذیرفته است، اما گرایشهایی به سمت این مبنا در قوانین خاص زیستمحیطی و رویه قضایی، به ویژه در مواجهه با فعالیتهای خطرناک نفتی، مشاهده میشود. در مقابل، کنوانسیون CLC به طور صریح مسئولیت محض را مبنای اصلی جبران خسارات آلودگی نفتی قرار داده و مالک کشتی را بدون نیاز به اثبات تقصیر، مسئول میداند. این تفاوت در صراحت و جامعیت پذیرش مبنا، خلأهایی را در نظام حقوقی ایران ایجاد میکند. برای افزایش کارایی نظام حقوقی ایران در مقابله با آلودگیهای نفتی، ضروری است قوانین داخلی به سمت پذیرش صریح و جامع مسئولیت محض سوق یابند و با پیوستن کامل به کنوانسیونهای بینالمللی مرتبط، از جمله CLC و پروتکلهای تکمیلی آن، زمینه را برای جبران سریع و مؤثر خسارات فراهم آورند.
